The purpose of the website is to present the services offered by Artist Management, a SaaS solution mainly aimed at talent agencies representing actors, models, extras, advertising talent, fiction talent, kids agencies and other professionals in the audiovisual, advertising or artistic sectors.
Through the website, users may obtain information about the Platform, request a demo, contact the commercial team, access information on support and training, and consult the applicable legal terms.
Access to and use of the website gives the visitor the status of user and implies acceptance of this Legal Notice.
The user undertakes to use the website lawfully, diligently and in good faith, refraining from any action that may damage, disable, overload or impair the website, its systems, content or services.

These Terms and Conditions govern the contracting and use of Artist Management, a SaaS platform owned by:

Hereinafter, “Artist Management”, the “Platform”, the “Service” or the “Provider”.
The contracting, registration, access to or use of Artist Management implies the express acceptance of these Terms and Conditions, as well as the Privacy Policy, Cookie Policy, Data Processing Addendum, Security Measures and, where applicable, any specific commercial terms accepted by the Client.
If the person accepting these terms acts on behalf of a company, agency or organisation, that person declares that they have sufficient authority to bind such entity contractually.
Client: the company, agency, professional or organisation that contracts Artist Management.
Authorised User: a natural person authorised by the Client to access the Platform.
Talent: an actor, actress, model, extra, minor, representative or any person whose data is entered by the Client into the Platform.
Client Data: information, documents, images, videos, texts, communications, databases, personal data or any other content uploaded, managed or generated by the Client in the Platform.
Services: the functionalities offered by Artist Management, including talent management, casting management, profiles, documents, photographs, videos, selections, shared links, communications, clients, billing, support, training and any other available modules.
Artist Management provides a SaaS platform for the professional management of representation agencies, enabling, among other features:
– Managing talent profiles.
– Centralising photographs, videos, professional data and documents.
– Creating and managing castings, roles, selections and statuses.
– Sharing information with clients or third parties through links.
– Managing casting-related communications.
– Organising documentation and availability.
– Facilitating internal processes for representation agencies.
The specific functionalities will depend on the contracted plan, the account configuration and the applicable commercial terms.
Artist Management is mainly aimed at companies, agencies and professionals. Unless expressly stated otherwise, the Service is not intended for end consumers.
The Client declares that it contracts the Service within the framework of its business or professional activity.
In order to access the Service, it will be necessary to create an account or receive access credentials.
The Client undertakes to:
– Provide accurate and up-to-date information.
– Keep its credentials secure.
– Not share users or passwords with unauthorised persons.
– Immediately notify any improper use, loss or unauthorised access.
– Keep the list of Authorised Users up to date.
The Client shall be responsible for all activity carried out through its user accounts, unless it can prove a failure exclusively attributable to Artist Management.
Use of Artist Management is subject to payment of the fees, prices or commercial terms applicable at any given time.
The prices, billing period, usage limits, included functionalities, taxes and payment method shall be those indicated in the commercial proposal, contracting process, invoice or document accepted by the Client.
Unless otherwise agreed:
– Fees shall be billed monthly or annually.
– Amounts do not include taxes, unless expressly stated.
– Non-payment may result in suspension or cancellation of the Service.
– Amounts paid are non-refundable unless required by law or expressly agreed.
Artist Management may offer free trial periods, demos or commercial promotions.
Such conditions may be subject to time, functional or usage limitations.
Once the trial period has ended, access may be suspended or converted into a paid subscription if this was duly informed and accepted during the contracting process.
The Client is responsible for all data, documents, images, videos, texts and content that it enters or manages in the Platform.
In particular, the Client warrants that:
– It has a valid legal basis for processing the personal data it enters.
– It has duly informed the talent, representatives, clients, workers, collaborators or affected third parties.
– It has the consents, authorisations or rights necessary to upload, store, use or share images, videos, documents, CVs, professional data or any other content.
– It will not enter excessive, unlawful, inaccurate or unnecessary data.
– It will keep the information up to date where necessary.
– It will handle the data protection rights that correspond to it as data controller.
– It will not use the Platform for unlawful, discriminatory, abusive purposes or purposes contrary to applicable regulations.
Artist Management does not decide what data the Client enters, for what purpose it processes such data or with whom it shares it. The Platform provides the technical tool for the Client to manage its professional activity.
When the Client uses Artist Management to manage personal data relating to minors, the Client declares and warrants that it has the necessary legal basis for such processing.
In particular, the Client shall be responsible for obtaining, retaining and being able to evidence, where applicable, the authorisation or consent of the minor’s parents, legal guardians or representatives.
The Client shall also be responsible for properly informing legal representatives about the use of the Platform, the purpose of processing, the recipients of the data and the applicable rights.
Artist Management may incorporate functionalities designed to facilitate the management of minors’ data, but it does not replace the Client’s legal responsibility towards minors or their legal representatives.
The Client warrants that it has the necessary authorisations to upload, store, process, reproduce, share or send photographs, videos, audio files, books, CVs, composites or any other image or voice material relating to talent.
The Client shall be responsible for defining the recipients of such materials and ensuring that their use complies with the authorisations obtained.
Artist Management shall not be liable for claims arising from lack of authorisation, improper use or unauthorised communication of images, videos or materials entered by the Client.
The Platform may allow the generation of links, presentations, selections, profiles or materials shareable with clients, producers, casting directors or other third parties.
The Client shall be responsible for:
– Deciding what information it shares.
– Determining the recipients.
– Verifying that it has authorisation to share such information.
– Avoiding the sharing of sensitive or unnecessary data.
– Revoking or limiting links when they are no longer necessary.
Artist Management may establish technical protection measures, but the Client must use these functionalities responsibly.
The Client undertakes not to use the Platform for:
– Unlawful activities.
– Infringing third-party rights.
– Uploading content without authorisation.
– Processing personal data without a legal basis.
– Hosting malware, viruses or malicious code.
– Performing reverse engineering, scraping, attacks, unauthorised penetration testing or improper access.
– Overloading the Platform.
– Attempting to access data belonging to other clients.
– Circumventing security measures.
– Using the Platform to send spam or unsolicited communications.
– Processing special categories of data without sufficient legal basis.
Artist Management may suspend access if it detects use contrary to these terms, applicable regulations or the security of the Platform.
Client Data shall remain the property of the Client or of the corresponding third parties.
Artist Management does not acquire any ownership rights over Client Data.
The Client grants Artist Management a limited, non-exclusive authorisation necessary to host, process, transmit, display, technically copy, back up and manage such data only to the extent necessary to provide the Service.
Artist Management retains all intellectual and industrial property rights over the Platform, software, code, designs, databases, documentation, trademarks, logos, processes, interfaces and functionalities.
The Client receives only a limited, temporary, revocable, non-exclusive and non-transferable right of use while its subscription remains active.
Copying, modifying, distributing, reselling, sublicensing, decompiling, reverse engineering or exploiting the Platform without express authorisation is prohibited.
Artist Management shall make reasonable efforts to keep the Platform available.
However, the Client accepts that interruptions may occur due to:
– Scheduled maintenance.
– Updates.
– Technical incidents.
– External providers.
– Third-party attacks.
– Force majeure.
– Connectivity problems not attributable to Artist Management.
Artist Management may modify, improve, expand, replace or withdraw functionalities, provided that such changes do not deprive the contracted Service of its essential content.
Support and training shall be governed by the “Support and Training / SLA” document published by Artist Management or by any specific terms agreed with the Client.
Support requests should preferably be channelled through soporte.artistmanagement.app.
A request for a new functionality does not imply an automatic obligation to develop it, unless expressly agreed in writing.
Artist Management may suspend access to the Service, in whole or in part, when:
– There is non-payment.
– Unlawful or abusive use is detected.
– It is necessary to protect the security of the Platform.
– The Client breaches these terms.
– There is a legal or administrative requirement.
– There is a risk to other clients, systems or third parties.
Where reasonably possible, Artist Management will notify the Client in advance.
The Client may cancel the subscription in accordance with the applicable commercial terms.
After cancellation, access to the account may be deactivated. Artist Management may retain the data for a limited period in order to allow export, address legal responsibilities, resolve incidents, comply with tax obligations or maintain technical backups.
Once the applicable periods have expired, the data may be deleted or anonymised in accordance with the Privacy Policy and the Data Processing Addendum.
The parties undertake to keep confidential all non-public information to which they have access as a result of contracting or using the Platform.
This obligation shall remain in force even after the contractual relationship has ended.
Information that is public, already lawfully known by the receiving party, or required to be disclosed by law shall not be considered confidential information.
The processing of personal data shall be governed by the Privacy Policy and, where Artist Management processes personal data on behalf of the Client, by the Data Processing Addendum.
The Client acknowledges that, with respect to data relating to talent, representatives, clients and third parties entered into the Platform, it normally acts as data controller, while Artist Management acts as data processor.
To the maximum extent permitted by law, Artist Management shall not be liable for:
– Casting, selection or hiring decisions made by the Client or third parties.
– Incorrect, incomplete or unauthorised data entered by the Client.
– Improper use of links shared by the Client.
– Legal breaches by the Client towards talent, minors, clients or third parties.
– Indirect losses, loss of profit, loss of opportunities, reputational damage or claims arising from the professional use of the information.
– Incidents caused by external providers, internet connection, Client devices or improper use of the Platform.
The total liability of Artist Management, except in cases of wilful misconduct, gross negligence or liability that cannot legally be limited, shall be limited to the amount actually paid by the Client during the [3/6/12] months prior to the event giving rise to the claim.
Artist Management may modify these Terms and Conditions to adapt them to legal, technical, commercial or functional changes.
When the changes are substantial, the Client shall be informed with reasonable notice via the website, email or notification within the Platform.
Continued use of the Service after the changes take effect shall imply acceptance of such changes.
These Terms are governed by Spanish law.
Unless applicable regulations provide otherwise, the parties submit to the Courts and Tribunals of Sabadell.

Artist Management does not decide what data the Client enters or the specific purpose of such processing.

Artist Management may be used by agencies that manage underage talent.
When minors’ data is entered by the Client, the Client shall be responsible for having the necessary legal basis, including, where applicable, the authorisation or consent of parents, guardians or legal representatives.
Artist Management will process such data only in accordance with the Client’s instructions and within the framework of providing the Service.
We may send commercial communications related to Artist Management when:
– The user has requested or authorised them.
– There is a prior contractual relationship and the communication refers to similar products or services.
– There is a legal basis that allows it.
The user may object or unsubscribe at any time through the link included in each communication or by writing to comunicaciones@artistmanagement.app.
We may communicate data to:
– Technology providers necessary to provide the Service.
– Hosting providers.
– Transactional email providers.
– Support providers.
– Payment providers.
– Email marketing providers.
– Analytics tools, if used.
– Tax, accounting or legal advisers.
– Public authorities, courts or regulators where there is a legal obligation.

In order to provide the Service, we may use providers that process data on our behalf or on behalf of the Client.

Some providers may be located outside the European Economic Area or may process data from countries that do not provide an equivalent level of protection.
Where this occurs, Artist Management will adopt the legally required safeguards, such as adequacy decisions, standard contractual clauses, supplementary measures or other valid mechanisms under applicable regulations.
Data will be kept for the time necessary to fulfil the purposes for which it was collected and, thereafter, for the periods necessary to comply with legal obligations or address possible liabilities.
By way of guidance:
– Requests for information: 12 months.
– Commercial communications: until the user requests unsubscribe.
– Client data: for as long as the contractual relationship remains in force.
– Invoices and accounting data: for the legally required periods.
– Support tickets: 3 months.
– Technical and security logs: 12 months.
– Client Data in the Platform: for as long as the contract remains in force and in accordance with the Data Processing Addendum.
– Backups: during the technical period defined in the Security Measures.

Among other measures, the Platform may include:
– Access through credentials.

– Logical separation of data by client.
– Backups.
– Permission controls.
– Technical records.
– Incident management.
– Confidentiality measures.
– Technical updates.
No system is absolutely secure, so the Client must also adopt appropriate measures to protect its credentials, devices and users.

Ambas partes acuerdan regular el tratamiento de datos personales que Artist Management realiza por cuenta del Cliente en el marco de la prestación del Servicio.
El presente Anexo regula el acceso y tratamiento de datos personales por parte de Artist Management como encargado del tratamiento, con la finalidad de prestar al Cliente la plataforma SaaS Artist Management.
El encargo tendrá la misma duración que la relación contractual entre el Cliente y Artist Management.
Una vez finalizada la relación, Artist Management procederá a suprimir, devolver o bloquear los datos conforme a lo establecido en este Anexo, salvo que exista obligación legal de conservación.
Artist Management tratará datos personales con la finalidad de:

Artist Management tratará los datos personales únicamente siguiendo instrucciones documentadas del Cliente.

Si Artist Management considera que una instrucción infringe la normativa aplicable, informará al Cliente, salvo que la normativa lo prohíba.

El Cliente autoriza a Artist Management a recurrir a subencargados necesarios para prestar el Servicio.
La lista de subencargados estará disponible en la web o previa solicitud a comunicaciones@artistmanagement.app
Artist Management informará al Cliente de cambios relevantes en subencargados cuando sea necesario, permitiendo al Cliente formular objeciones razonables por motivos relacionados con protección de datos.
Artist Management formalizará con los subencargados obligaciones de protección de datos equivalentes a las previstas en este Anexo.
Artist Management no realizará transferencias internacionales de datos personales salvo que sean necesarias para prestar el Servicio o utilizar proveedores autorizados.
Cuando existan transferencias internacionales, Artist Management aplicará garantías adecuadas conforme a la normativa vigente.
Artist Management aplicará medidas técnicas y organizativas apropiadas para proteger los datos personales, incluyendo, entre otras:
Las medidas concretas se describen en el documento “Medidas de Seguridad”.
Artist Management notificará al Cliente, sin dilación indebida, las brechas de seguridad de datos personales que afecten a datos tratados por cuenta del Cliente, cuando tenga constancia de ellas.
La notificación incluirá, en la medida en que esté disponible:
El Cliente será responsable de determinar si procede notificar a la autoridad de control o a los interesados.
Cuando Artist Management reciba una solicitud de derechos relativa a datos tratados por cuenta del Cliente, la remitirá al Cliente o indicará al interesado que debe dirigirse al responsable, salvo que exista obligación legal de actuar directamente.
Artist Management asistirá razonablemente al Cliente para atender dichas solicitudes cuando sea técnicamente posible.
Finalizada la prestación del Servicio, Artist Management, a elección del Cliente y salvo obligación legal en contrario, suprimirá tras 30 días naturales los datos personales tratados por cuenta del Cliente.
Transcurrido dicho plazo, Artist Management eliminará los datos activos.
Las copias de seguridad podrán conservarse durante el periodo técnico definido en las Medidas de Seguridad, quedando bloqueadas y protegidas hasta su eliminación automática.
Artist Management pondrá a disposición del Cliente información razonable para demostrar el cumplimiento de este Anexo.
Las auditorías deberán solicitarse con antelación razonable, limitarse a aspectos relacionados con el Servicio contratado y no comprometer la seguridad, confidencialidad o derechos de otros clientes.
Cuando una auditoría genere costes extraordinarios, las partes podrán acordar previamente su alcance y coste.
El Cliente será responsable de la licitud de los datos introducidos, de la información proporcionada a los interesados y de la base jurídica del tratamiento.
Artist Management será responsable de cumplir sus obligaciones como encargado del tratamiento conforme a este Anexo y la normativa aplicable.
Este documento regula las condiciones generales de soporte técnico, atención al Cliente, formación inicial y gestión de solicitudes relacionadas con Artist Management.

Las solicitudes podrán clasificarse como:
La Plataforma no está disponible para el Cliente o existe una interrupción grave que impide el uso esencial del Servicio.
Ejemplos:
Una funcionalidad relevante no funciona correctamente, pero existen alternativas temporales o el Servicio sigue siendo parcialmente operativo.
Error que afecta a una funcionalidad concreta sin impedir el uso general de la Plataforma.
Consultas, dudas de uso, ajustes menores, errores visuales, peticiones no urgentes o solicitudes de información.
Solicitud de desarrollo, modificación, personalización, integración o cambio funcional.
Estas solicitudes serán evaluadas, pero no implican obligación de implementación salvo acuerdo expreso.

La respuesta inicial no equivale necesariamente a resolución definitiva.
La resolución dependerá de la naturaleza de la incidencia, disponibilidad de información, colaboración del Cliente, proveedores externos y complejidad técnica.
Para poder atender correctamente una incidencia, el Cliente deberá facilitar:

No estarán incluidos en el soporte estándar, salvo acuerdo específico:
Durante el primer mes de contratación, Artist Management podrá ofrecer formación inicial de onboarding conforme a las condiciones comerciales aplicables.
Condición estándar sugerida:
Las sesiones no realizadas por causa imputable al Cliente podrán considerarse consumidas si no se cancelan con al menos 48 horas de antelación.
En determinadas incidencias, el equipo de Artist Management puede necesitar acceder a datos o configuraciones de la cuenta del Cliente.
Dicho acceso se realizará únicamente para prestar soporte, resolver incidencias, verificar errores o atender instrucciones del Cliente.
El personal autorizado estará sujeto a deber de confidencialidad.
Las peticiones de nuevas funcionalidades serán analizadas por Artist Management.
Artist Management podrá:
El envío de una petición no genera obligación de desarrollo ni plazo de entrega.
Artist Management podrá realizar tareas de mantenimiento, actualización o mejora.
Cuando el mantenimiento pueda afectar significativamente a la disponibilidad, se intentará avisar con antelación razonable, salvo urgencia técnica o de seguridad.
Algunas incidencias pueden depender de proveedores externos, como hosting, pasarelas de pago, correo electrónico, DNS, servicios de terceros o conectividad.
Artist Management no será responsable de interrupciones causadas por terceros ajenos a su control, aunque realizará esfuerzos razonables para restaurar el Servicio o coordinar la resolución.

Artist Management utiliza determinados proveedores externos para prestar, mantener, proteger y gestionar sus servicios.

Artist Management puede utilizar proveedores externos para gestionar sus propias comunicaciones comerciales, newsletters, automatizaciones de marketing, formularios o seguimiento de campañas.
Estos proveedores no tratan, con carácter general, los datos operativos que los clientes introducen en la Plataforma sobre sus talentos, castings o documentos, salvo que se indique expresamente lo contrario.

El soporte técnico de Artist Management es prestado por personal autorizado por Artist Management.
El personal de soporte solo accederá a datos de clientes cuando sea necesario para resolver una incidencia, prestar asistencia, verificar errores o ejecutar instrucciones del cliente.
Dicho acceso estará sujeto a obligaciones de confidencialidad, acceso limitado y uso exclusivamente vinculado a la prestación del servicio.
Artist Management podrá actualizar esta lista cuando incorpore, sustituya o deje de utilizar proveedores relevantes.
Cuando un cambio pueda afectar de forma significativa al tratamiento de datos personales de los clientes, Artist Management podrá comunicarlo mediante email, aviso en la web, notificación dentro de la Plataforma o actualización de esta página.
A efectos de esta lista, se entiende por garantías la existencia de medidas contractuales, técnicas y organizativas destinadas a proteger los datos personales tratados por los proveedores.

Este documento describe las medidas técnicas y organizativas aplicadas por Artist Management para proteger la información tratada en la Plataforma.
Las medidas pueden evolucionar con el tiempo en función de cambios técnicos, legales, organizativos o de seguridad.
Artist Management aplica mecanismos de control de acceso para limitar el acceso a la Plataforma y a la información alojada en ella.
Medidas aplicables:
Artist Management limita el acceso interno a los datos a personal autorizado.
El personal o colaboradores con acceso a información confidencial estarán sujetos a obligaciones de confidencialidad.
El acceso a datos de clientes se realizará únicamente cuando sea necesario para:
La Plataforma está diseñada para separar lógicamente los datos de cada Cliente, evitando accesos cruzados no autorizados.
La Plataforma utilizará comunicaciones cifradas mediante HTTPS/TLS para proteger la transmisión de datos entre el usuario y el servidor.
Artist Management podrá realizar copias de seguridad para proteger la disponibilidad e integridad de la información.
Las copias de seguridad tendrán finalidad exclusivamente técnica y de recuperación ante incidencias.
Artist Management aplica medidas destinadas a mantener la disponibilidad de la Plataforma.
Medidas posibles:
La disponibilidad puede verse afectada por mantenimiento, incidencias, ataques, proveedores externos o causas de fuerza mayor.
Artist Management podrá mantener registros técnicos para:
Artist Management dispone de un procedimiento para analizar y responder ante incidencias de seguridad.
En caso de brecha de datos personales que afecte a datos tratados por cuenta del Cliente, Artist Management notificará al Cliente sin dilación indebida, aportando la información disponible para que el Cliente pueda valorar sus obligaciones legales.
Artist Management aplicará medidas razonables de mantenimiento y actualización para reducir riesgos técnicos.
Medidas posibles:
Artist Management seleccionará proveedores que ofrezcan garantías razonables de seguridad y protección de datos.
Los proveedores relevantes se detallan en la Lista de Subencargados.
El Cliente también debe aplicar medidas de seguridad en su propio entorno.
